Flower Moon Cakes & Bakes – Terms and Conditions

For wedding cakes a £50 non-refundable deposit is required to hold the date for your
wedding, required within one week of booking to secure your order. Without the deposit,
we will not hold the date. Priority will be given to the paying customer. The remainder
must be paid no later than 4 weeks before the event, if the balance has not been received
then your cake will not be made.

For non-wedding cakes 50% non-refundable deposit is required within one week of
booking to secure your order. Without the deposit, we will not hold the date. Priority will
be given to the paying customer. The final payment is due on collection/ delivery of your
cake(s). If the final payment is not received then your cake will not be released to you.
Any issues with the quote for your order or delivery must be brought up before paying the
deposit.

If subsequently any issues with the cost of your cake arise you must inform me no later
than 4 weeks before your event so we can make alternative arrangements.
The deposit is non refundable unless for whatever reason I cannot fulfil the order, however
it does come off the total cost of the cake. If in the unlikely event I am not able to make
your cake I will give you as much notice as I possibly can depending on the situation.
I reserve the right to cancel the order if the client exhibits unreasonable behaviour, or
differences cannot be overcome. The deposit will be refunded in this case, minus
whatever costs have already been incurred, at my discretion.

Due to the current uncertainty arising from the COVID-19 global pandemic, which may
cause supply problems that cannot be foreseen, substitutions may be necessary and some
flavour options may need to be changed due to supply issues.

Changes and Alterations:

Any alterations to the agreed design and flavours can be made until 4 weeks before the
wedding which is when I will have started the work, but please note that any drastic
changes, including the flavours may affect the price.

If the date needs to be changed for whatever reason, as long as I have more than 2
weeks notice and I have availability for the new date then there will be no charge for this.
If for whatever unlikely reason the order is cancelled by yourselves however, then a partial
refund may be given on my discretion.

How to Make Payments:

Payment can be made via bank transfer or cash. Deposits can also be paid via PayPal.

Complaints:

Once I have delivered your cake, if there are any problems with it I must be notified
immediately so that I can return to fix the issue before the cake is served to your guests.

In some situations I may not be able to return if I have travelled away from the area, or the
problem may not be able to be fixed, but I will do my best to address the situation at that
time. Once the cake has been cut I will not return to discuss any problems. If I am unable
to return, please take photos of the area you are concerned about, before the cake is
taken to be cut, and do not serve that tier to your guests so that I can look at the
problem. If no evidence is provided, and the cake is no longer there, I will not accept that
there was a problem.

Should there be any problems regarding quality or the cake itself which could not be seen
before it was cut, such as the wrong flavour cake was provided, the cake must not be
served to any guests. If it is unsuitable it must be returned to me in its entirety for any
refunds to be considered. If you do choose however to serve the cake to your guests,
then you are accepting the cake, and a full refund will not be given. A small, discretionary
refund may be offered depending on the situation and the extent of the mistake.
I cannot be held responsible for spoilt cake due to poor storage at your venue, or any
damage caused by moving the cake from its original location.

Any unserved cake kept on grounds of quality must be returned to me the next day so I
can look into it. This cake must not be kept in the fridge, and must be well wrapped in
cling film so it does not spoil and dry out overnight. I will not agree there is a flaw with
the quality of the cake if the cake isn’t actually spoilt or unpleasant to eat. If the cake is
not well wrapped and stored as per instructions, I can not determine the problem and no
refund will be given.

Outside Events:

Any cake(s) placed outside during an event has the possibility of melting or deforming
due to the heat. We are not liable in any way for damage to cakes once they have been
delivered/collected.

If the weather is unusually hot, etc. we recommend bringing the cutting of the
cake forward so that the cake can then be moved to a cooler place. In the case of a cake
being left out in heat for too long or being attacked by pests, the person serving the cake
may take the view that the cake is no longer safe to serve. This is a necessary food
safety measure and liability does not rest with
either Flower Moon Cakes and Bakes or the server.

Cake Location:

It is the responsibility of the customer to ensure the venue supply a suitable table and
location for the cake(s) to be displayed. Once again, we are not liable in any way for the
cakes once delivered or collected.

Delivery of Cakes:

The cost of delivery will be made clear in the price quoted. If the venue is changed and of
a further distance, additional charges may apply. Although care is taken when
transporting your cake, damages in transit can happen. We carry special cake repair kits
for circumstances where damage may occur. All cakes will be repaired at the venue to as
close to the original design as possible. We cannot be held liable for any damage that is
rendered to the cake at the venue once we have left the premises. It is with this in mind
that we require somebody responsible, to check that they are happy with the cake before
we leave.

Collection of Cakes:

On collection of cakes, we are not liable or responsible once the cake has left our
premises. You should ensure your vehicle is clean and tidy before collection, cakes
should be placed in the boot on a non-slip mat. We do everything in our power to provide
a well-structured cake, but please note, cakes can be very fragile so you must drive with
reasonable care.

Design and Alterations:

It is your responsibility to read and check the quote thoroughly; any amendments should
be made in writing. If requested we will endeavour to adjust the design where possible,
but sometimes this is not possible due to the nature of the request or amount of notice
given.

If the alteration affects the cost, or preparation work for the original design has
already been undertaken, then your balance will be adjusted accordingly. Please warn us
when you pay your deposit if you are undecided on the design. We reserve the right to
change the design at any point if circumstances beyond our control, may compromise the
quality of the finished cake e.g. melting due to weather, supply issues due to COVID-19.

Each cake is made individually by hand, so although every effort is made to ensure
consistency, a small amount of variation may occur. Any cake ordered from a picture
created by another cake maker can only be reproduced by Flower Moon Cakes and
Bakes as our interpretation of the cake, and will not be an exact replica of the cake in the
photograph. Flower Moon Cakes and Bakes are happy to use photographs for cakes as
inspiration for designs but cannot guarantee an exact design match.

Allergies and Special Dietary Requirements:

Please discuss with us if any of your guests have special dietary requirements. Cakes can
be made egg free, alcohol free, gluten free, soya free and dairy free by request. But
please be aware cakes are cooked in a kitchen that uses all of the above ingredients as
well as Nuts. Cakes can also be contaminated at the venue via other products, which we
cannot control.

Non-Edible Items:

Most cakes contain small proportions of inedible items, it is the client’s responsibility to
ensure these are removed by your caterer/guests before consumption e.g. support
dowels in tiered cakes, ribbon, wires in sugar flowers, support picks in models. We will
show the responsible person where any non-edible items are on the cake before we leave
the premises or before you collect the cake.

Best Before Date:

Your cake is baked to ensure it is fresh for the date of your event. We cannot guarantee its
quality if its consumed more than 48 hours after the event. Our cakes are made entirely of
natural ingredients, so we’d like to remind you that because of this they will not have the
extended shelf life of most supermarket cakes, which contain additives/preservatives.

Do not at any point allow your cake to be put in the fridge unless specifically told do by
myself for food safety reasons. This will cause the sponge to dry out and the fondant to
go sticky.

IMPORTANT INFORMATION REGARDING THE USE OF FRESH FLOWERS

If your florist is providing fresh flowers and foliage, please ensure they know to provide
me with FULL STEMMED FLOWERS, in good condition. Foliage and flowers for the cake
cannot be simply “what is left over” from the other arrangements. Your cake is a focal
point and the flowers provided should reflect this.

The exact style of the arrangement is dependant on the style we have discussed, and the
flowers and foliage provided on the day. For example of the flowers provided are of poor
structural nature or poor quality, it will affect the arrangement. I will do the best I can with
what is provided, but it may not be to the exact specifications provided. Please also bear
in mind you may wish to provide extra to arrange around the stand.

Fresh flowers and foliage must have been kept AS CLEAN AS POSSIBLE, AND IN NO
WAY CONTAMINATED / TOXIC / POISONOUS. I cannot be held responsible for
identifying plants provided, nor for any adverse reactions experienced. I am not a botany
expert and cannot reasonably be expected to be so. This safeguard is the responsibility
of the commissioning client and of the florist who has been commissioned to provide
appropriate materials.

If I feel that there may be a risk of contamination or toxicity I reserve the right to refuse
placement of vegetation on the cake, for reasons of public safety, however
SAFEGUARDING AGAINST TOXICITY AND ADVISING THE CATERERS OF ANY
POTENTIAL ISSUES IS YOUR RESPONSIBILITY and categorically does not rest with
Flower Moon Cakes and Bakes or representatives of Flower Moon Cakes and
Bakes. This safeguarding includes asking guests if they could have a reaction to any
plants present.

Please ensure that your florist understands that by providing vegetation for use on a cake,
they are subject to the FSA’s food contact legislation 1935/2004, and are responsible for
identifying any toxicity / contamination issues, taking measures to avoid them and
advising all parties of any issues.

Flower Moon Cakes and Bakes cannot be held responsible if flowers are not provided by
the florist within the prearranged timeframe available for cake decoration, nor if the
flowers are of bad / unsuitable quality, affecting my ability to create a pleasing display.
This is the responsibility of the florist.

Agreement and Payment Instructions:

By paying the deposit you confirm that you have read and are agreeing to these terms. If
there are any elements you are unsure of, please ask before payment is made. Please
also note that until a deposit is paid, the date is not booked and may be given to another
party. I will not do this however without attempting to contact you and inform you of the
situation to allow yourself the chance to book in.

Please ensure you use your name as a reference so I can match it back to your order.
